StatusLaw or process only Last reviewed 2026-10-14
Applies at150 MW or more expected peak demand for the state-law review process (Act 2026-610, effective October 1, 2026); 30 MW or more for a special contract under Rate BTAL (Docket U-5024)
What the filing saysNOT A PUBLISHED TARIFF: terms are set in individual contracts reviewed by the PSC. The Alabama PSC adopted its review procedure on about October 6, 2026 (generic Docket 33709): the Commission must vote within 90 days or the contract is deemed approved (the earlier proposal was 60 days); it must find the pricing recovers the incremental cost of serving the data center and benefits other customers; Alabama Power files a public version of each contract and gives staff and the Attorney General an unredacted copy. Parties note the rules set no minimum terms that every contract must include, and contract length, minimum bill and capacity were redacted in the contract filed so far. Smaller loads use Rate FCR or Rate BTAL special contracts. Ask Alabama Power for the contract form.
