Large-load tariff for data centers: what is on file, the terms the filings state, and where each fact comes from. Terms a filing does not state are marked, never guessed.

What the filing saysRe-checked 2026-11-05 (read directly, citizenscount.org bill pages for HB 1722, SB 439, HB 1265): HB 1722 ('Regulate large energy use facilities'), which would have directed the PUC to create a retail-electric classification and tariff schedule specifically for facilities drawing 20MW+ at peak (naming data/computer-processing/web-hosting centers, to prevent cost-shifting to residential/commercial ratepayers), was killed in the House on a floor vote March 11, 2026 (public hearing Feb 9, 2026) -- resolving the prior 'outcome not confirmed' note below. A related framework/incentive bill, HB 1739, was found 'inexpedient to legislate' Feb 19, 2026. SB 439 (would have given towns explicit zoning/noise authority over data centers) passed the Senate Jan 29, 2026 but was tabled in the House May 14, 2026. HB 1265 (a one-year statewide construction moratorium) was killed in the House March 11, 2026. No PUC docket was found on any of this. For the 2027 session, two new moratorium bills have been filed but not yet voted on: one from Sen. Daniel Innis (statewide pause) and one from Rep. Thomas Cormen (through end of 2028, 20MW+ threshold). Gov. Kelly Ayotte has said she will propose a likely multi-year data-center construction moratorium in her 2027 budget. Bottom line: no large-load/data-center tariff exists at the NH PUC for any NH utility, and the 2026 mechanism that would have created one failed.
