Large-load tariffs
Approved Checked 2026-10-17
ThresholdExpected capacity requirement of 5,000 kW (5 MW) or greater
StatusLPCS covers large power users taking ICS or ITS service with expected capacity of 5,000 kW or greater, new or existing load. Charges are defined in the service agreement for energy, transmission, and administration, with a microgrid management fee. Transferring existing load requires excess load under the schedule. Read in full from Black Hills' Wyoming P.S.C. Tariff No. 14 (LPCS sheets) on 2026-10-17: the customer must sign an Agreement, filed confidentially with the Commission before billing, and must provide back-up service for its load through Eligible Capacity Resources at its own cost; a customer must give a minimum of four years' notice to transfer load from this schedule to another rate schedule, and may terminate service on 10 days' notice subject to the obligations in its Agreement. The term, any collateral and any exit fee are in the Agreement, not the schedule. (The 13,000 kW figure that appears in the same tariff book belongs to the ICS and ITS industrial schedules, not to LPCS.)

ThresholdLoad additions above 45 MW, either at the request or forecast within 4 years
StatusFERC-APPROVED (Aug 14, 2026, per Tri-State), subject to a compliance filing. FERC Docket ER26-1929 (revised tariff filed March 26, 2026; an earlier version was rejected in ER25-3316). Applies to member cooperatives' large loads: a security payment, a minimum term, minimum monthly demand and energy charges, and rules for bringing your own resources. The Data Center Coalition objected on FERC jurisdiction. The specific percentages and years were not read. If a site is in a Tri-State member cooperative's territory, the HILT governs the wholesale side and the member sets retail terms.

StatusLOWER CONFIDENCE. Basin adopted a Large Load Commercial Program in June 2025 so that new large loads bear the generation and transmission cost and risk of serving them and existing members are shielded. Basin reports 26 applications since June 13, 2025, 17 active. A multi-gigawatt data center campus with a NextEra gas plant in Mercer County, North Dakota is being developed under the program. Contract terms and rates were not found.

Interconnection & regulatory guidance
Utility-specific — no statewide guidance resolves without naming a utility, but real tariff research exists above for Cheyenne Light, Fuel and Power (Black Hills Energy Wyoming), Large Power Contract Service and Tri-State Generation and Transmission Association (Colorado, wholesale to cooperatives), High Impact Load Tariff and Basin Electric Power Cooperative (Dakotas and Montana), Large Load Commercial Program. Interconnection process for a specific utility can be confirmed directly once that utility is identified for your site.
